ISLAMABAD: Justice Qazi Faiz Issa has apologized to the Chief Justice of Pakistan for being a part of any bench. Justice Faiz Issa will write a dissenting note in the development fund case this week.
According to details, Justice Qazi Faiz Issa wrote a letter to the Chief Justice of Pakistan. Sources said that in the letter, Justice Qazi Faiz Issa apologized for being a part of any bench.
Sources said that the Chief Justice of Pakistan did not include Justice Faiz in any bench on the petition. Justice Faiz Issa will write dissenting notes in the development fund case this week.
It may be recalled that Justice Qazi Faiz Issa had taken notice of the newspaper report on the issue of giving development funds to the members of the Assembly by the Prime Minister.
Justice Qazi Faiz inquired whether it is in accordance with the constitution. And law for the Prime Minister to give funds to the members of the Assembly. If the funds are in accordance with the constitution, law, and court decisions, then the matter will be closed.
Justice Qazi Faiz said that if the development funds were in accordance with the constitution and law, the chapter would be closed. If the development funds were not in accordance with the constitution. The action would be taken and the matter would be referred to the Chief Justice for a bench.
Later, a five-member larger bench headed by the Chief Justice heard the petition in the Supreme Court. In a reply submitted by the Finance Secretary, the Prime Minister denied the allegation of providing development funds to the MLAs.
The Supreme Court had disposed of the case by declaring the reply submitted by the Prime Minister of Pakistan as satisfactory.
